For me, the drug war is simple.
A group of people believing themselves to be above the law - greater than even the Supreme Law of the Land - that cared nothing for the opinions of the courts worked up a ferver in the public that created a "scare."
This "scare tactic" or - as we'd call it today, terrorism, made the people DEMAND to be protected from an artificial threat...
That allowed those people, still believing themselves above the law, to rush in and claim all kinds of powers over a once free people.
The Controlled Substances Act is unconstitutional and invalid - as though it had never been written...
Not because it clearly exceeds Government's limited enumerated powers.
Not because it violates some medical right.
Not because "control of interstate commerce" doesn't mean control over anything Congress decides to control..
But because "possession, manufacture, and distribution" of PROPERTY is something inherent in ownership.
I cannot "possess and distribute" your car... clothing... home...
Anything belonging to you.
Your "right" to possess, distribute, and control the use of your property comes from inherent rights protected by the Amendments to the Constitution - particularly the 5th.
It doesn't matter if we "need a law" to protect society's morality... That law cannot exist.
It doesn't matter if we "need a law" to keep us safe from something we have no intentions of doing... That law cannot exist.
Personal conduct cannot be criminalized. Criminalization of non-criminal activities is forbidden by the Constitution.
Government's attempts to do so are nothing more than "mandates" or "edicts" which cannot come into being with a limited government who's powers are derived from the rights of the people.
Rights are something government cannot abrogate - or they have committed a crime.
Government cannot take away rights - or they have committed a crime.
Converting "possession of personal property one has created or purchased" into a "crime" is beyond the ability of Constitutional Government.
This "law" amounts to a taking - a deprivation of one's property - without due process (as legislative acts do not meet that requirement), nor is imprisonment "just compensation" for the property that has been "TAKEN" by legislative fiat.
Government has not "right to regulate" interstate commerce. They have the PRIVILEGE to regulate commerce.
Privileges can be revoked by the issuing party - the people.
Denial of a privilege is the RIGHT of the issuing party (absent any contractual violations).
Government broke the Constitutional Contract and disbanded any privileged powers they may have once held. This does not mean they now have "rights to be obeyed" nor powers greater than the privileges they had before this contractual violation.
Ignoring demands of Government to abandon one's rights... To "not do" what government has said "don't do" while causing injury to no one without their knowing consent cannot be converted into a crime.
The CSA is an unconstitutional licensing statute which proclaims that "ALL PROPERTY" falling into the category of "DRUGS" belongs solely to government, and is fully under their control.
Such a thing cannot be under the United States Constitution.
The exercise of a Constitutionally protected right cannot be converted into a privilege (license) issued by and controlled by Government.
Either property rights exist in this country - and the drug laws are invalid, or there are no property rights in this country, and Government is culpable of international crimes in human rights violations.
Either way, things don't bode well for Government, as their crimes are being exposed.
It's time to demand freedom.
It's time to demand justice.
And it's time to stop letting the majority use Government as a tool of oppression.
